Article 1: General provisions

The e-commerce website of BRUSIL BV, (available at the address www.bodegasguimara.com, hereinafter referred to as the “Site”) offers its customers the opportunity to purchase the products from its web shop online. These General Terms and Conditions ("Terms") apply to any order placed by a visitor to this e-commerce website ("Customer"). Placing an order via the BRUSIL BV web shop implies that the Customer has consulted these Conditions and explicitly accepts the applicability of these Conditions, to the exclusion of all other conditions that are available on the Site in advance. Additional conditions of the Customer are excluded, except when they have been accepted in advance, in writing and expressly by BRUSIL BV.


Article 2: Pricing

All prices quoted are expressed in EURO, including VAT and all other obligatory duties or taxes to be borne by the Customer. If delivery, reservation or administrative costs are charged, this will be stated separately. The indication of price only refers to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.


Article 3: Offer

Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is always possible that the information provided is incomplete, contains material errors, or is not up-to-date. Apparent mistakes or errors in the offer are not binding for BRUSIL BV. As far as the correctness and completeness of the information offered, BRUSIL BV is only bound by an obligation of means. BRUSIL BV is under no circumstances liable in the event of material errors, typesetting or printing errors.


If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service department in advance via info@bodegasguimara.com.


The offer is valid while stocks last and can be adjusted or withdrawn by BRUSIL BV at any time. BRUSIL BV cannot be held liable for the unavailability of a product..


Article 4: Online purchases & age verification when purchasing alcoholic drinks

By ordering online in the web shop at www.bodegasguimara.com, the buyer declares to BRUSIL BV that he has the legal age of 18 to buy and / or drink alcoholic beverages. In accordance with applicable law, it may be asked to prove that the Customer is over 18 years old at any time. In order to prevent abuse, you may be asked to prove after your purchase that you have reached the legal age of 18 years.


After payment, the wines are delivered to the specified address of the customer, either by our own logistics services or via DPD / Sending Wines.


The Customer can choose between the following payment methods:

  • by bank tranfer;
  • via credit card Visa / MasterCard;
  • via Bancontact / Mister Cash
  • via Paypal

The goods offered via the BRUSIL BV e-commerce website constitute an offer that is subject to the condition of acceptance by BRUSIL BV. BRUSIL BV is entitled to refuse an order as a result of a serious shortcoming of the Customer with regard to the order or any other order or agreement in which the Customer is involved.


Article 5: Delivery terms and execution of the agreement

Items ordered through the web shop www.bodegasguimara.com are delivered in Belgium and the Netherlands. Delivery is done by our own logistics services or via DPD / Sending wines. Unless otherwise agreed, the goods will be delivered to the Customer's place of residence within 14 days after full payment of the order. BRUSIL BV reserves the right NOT to deliver goods to minors..

Any visible damage and / or qualitative shortcoming of an article or other shortcoming in delivery must be immediately reported by the Customer to BRUSIL BV. The risk of loss or damage is transferred to the Customer as soon as the Customer (or a third party designated by him, who is not the carrier) has received physical possession of the goods. However, the risk already transfers to the Customer upon delivery to the carrier, if the carrier has been appointed by order of the Customer.

Article 6: Retention of title

The delivered items remain the exclusive property of BRUSIL BV until full payment by the customer. The customer undertakes everything necessary to inform third parties of BRUSIL BV's retention of title where necessary.

Article 7: Right of withdrawal

The provisions of this article only apply to Customers who, in their capacity as private consumers, purchase articles online from BRUSIL BV on the Site www.bodegasguimara.com.


In case the right of withdrawal applies: 


The Customer has the right to withdraw from the agreement within 14 calendar days without stating any specific reasons. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the goods. To exercise the right of withdrawal, the Customer must inform BRUSIL BV of his decision to withdraw from the agreement by means of an unambiguous statement (e.g. in writing by post, fax or e-mail at info@bodegasguimara.com). To meet the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired. 



The Customer must return or hand over the goods to BRUSIL BV, Tervurenlaan 216, 1150 Brussels, without delay, but in any case no later than 14 calendar days after the day on which he has notified BRUSIL BV of his decision to withdraw from the agreement. The direct costs of returning the goods are at the expense of the Customer. 



If the returned product has lost value in any way, BRUSIL BV reserves the right to hold the Customer liable and to claim compensation for any depreciation of the goods resulting from the use of the goods by the Customer. which goes beyond what is necessary to determine the nature, characteristics and functioning of the goods. Only articles that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back. 


If the Client cancels the agreement, BRUSIL BV will refund all payments received from the Client up to that moment, including the cost for the standard delivery costs if applicable, to the Client within a maximum of 14 calendar days after BRUSIL BV has been informed of the decision of the Customer to withdraw from the contract. In the case of sales agreements, BRUSIL BV can wait with the repayment until all goods are back in possession of BRUSIL BV, or until the Customer has demonstrated that he has returned the goods, whichever occurs first. Any additional costs resulting from the Customer's choice for a different method of delivery will not be refunded. BRUSIL BV reimburses the Customer with the same payment method with which the Customer carried out the original transaction, unless the Customer has explicitly agreed otherwise; in any case, the Customer will not be charged for such reimbursement.


Article 8: Warranty

Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of purchase by (if applicable, delivery to) the first owner. Any commercial guarantee does not affect these rights.


For items purchased online and delivered to the Customer's home, the Customer must contact customer service in advance via support@bodegasguimara.com, after which the Customer must return the item to BRUSIL BV at his own expense. When a defect is established, the Customer must notify BRUSIL BV as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 weeks after it has been established. Afterwards, any right to repair or replacement lapses.


The (commercial and / or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, incorrect storage, or any other abnormal or incorrect use. Nor does it apply to articles with a shorter lifespan, or wear articles. Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable, are deemed not to be hidden defects, unless the Customer proves otherwise. The warranty is not transferable.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights that BRUSIL BV has, in the event of non-payment or late payment from the date of overdue payment, the Client shall, by operation of law and without notice, owe interest of 10% per year on the unpaid amount. In addition, the Customer is legally and without notice due a fixed compensation of 10% on the outstanding amount, with a minimum of 60 euros per invoice. Without prejudice to the foregoing, BRUSIL BV reserves the right to take back all goods that have not been paid (in full).
